Age and residency rules

Who counts as a resident. To buy a resident annual licence "you must have permanent residency in New York State for more than 30 days." DEC defines residency as "a place where you maintain a fixed, permanent home, and to which you always intend to return. Owning property in NYS does not constitute residency." Active military members stationed in New York and full-time college students attending NYS institutions may purchase licenses and privileges for a resident fee. Lifetime licences require proof of residency for one full year preceding the application date.

Age-based rules

  • A fishing licence is required for individuals 16 years and older, so anglers under 16 do not need one. The Recreational Marine Fishing Registry likewise only applies at 16 and older.
  • New York does not sell a saltwater fishing licence. Anglers 16 and older fishing the marine and coastal district enrol in the free Recreational Marine Fishing Registry instead. Still required: The angler must enrol in the Recreational Marine Fishing Registry. Registration is valid for one full year (365 days) from the date you register. The registry itself is free, though a licence-issuing agent may charge a $1 print fee and online/phone transactions incur a $2 printing and mailing fee if printed materials are mailed (avoidable by choosing email delivery).

Freshwater and saltwater

New York licenses freshwater and saltwater fishing. Check which waters your license covers before you fish — a freshwater license does not cover saltwater unless the option explicitly says it does.

State license vs federal registry. NOAA Fisheries lists New York among the exempt states: anglers enrolled in New York's Recreational Marine Fishing Registry do not need to register through the National Saltwater Angler Registry. Tuna fishing in state waters additionally requires a NOAA highly migratory species permit.

Exemptions worth knowing

  • You do not need to register if you are fishing aboard an appropriately licensed party or charter boat in the marine and coastal district.
  • The requirement for a freshwater fishing licence is waived on New York's designated free fishing days. Still required: Although the requirement for a freshwater fishing license is waived during free fishing days, all other fishing regulations remain in effect. The waiver covers freshwater only — marine-district anglers still need the Recreational Marine Fishing Registry.
  • New York issues a free fishing licence to residents who are legally blind. Still required: This is a free licence, not a blanket exemption: the angler must apply to DEC with proof of legal blindness and carry the issued licence.
